Scaricare un’applicazione, creare un profilo su un social network, ordinare la cena mediante un servizio di consegna a domicilio, acquistare prodotti fisici su marketplace o contenuti digitali all’interno di shop online, iscriversi ad un servizio di streaming audio o video. Tutte queste attività hanno una serie di caratteristiche in comune: (i) si svolgono online, (ii) possono essere effettuate da chiunque possieda uno smartphone o un computer e una connessione ad Internet, e (iii) presuppongono la conclusione di un contratto tra chi fornisce il bene/servizio e chi lo acquista. Se è vero che, già di per sé, queste condizioni offrirebbero spunti interessanti per l’analisi delle dinamiche giuridiche sottese, ciò è ancor più vero se, oltre ai punti di cui sopra, se ne aggiungesse un altro: (iv) l’utente è minore d’età. Con la presente riflessione, si tenta di affrontare alcune delle tematiche più stimolanti relative alla possibilità per i minori di concludere validamente negozi giuridici online, e di ragionare circa l’applicabilità di talune eccezioni, quali quella delle frodi e degli atti minuti di vita quotidiana, anche in contesti digitali.
Downloading an application, creating a profile on a social network, ordering dinner through a delivery service, buying physical products on marketplaces or digital con- tent within online shops, subscribing to an audio or video streaming service. All of the above activities have at least three characteristics in common: (i) they take place online, (ii) they can be carried out by anyone with a smartphone or a computer and an Internet connection, and (iii) they require the entering into of a contract between the goods/services provider and the user/buyer. It goes without saying that the above conditions would already offer interesting grounds for the analysis of the surrounding legal aspects. However, things get more complex as we add another point to those mentioned above, namely: (iv) the user is underage. Through this analysis, we attempt addressing some of the most challenging issues around the possibility for minors to validly carry out transactions online, and discussing around the applicability of certain exceptions, such as frauds and minute acts of daily life, also in digital contexts.
