L’avvento della tecnologia blockchain in generale e il successivo approdo della blockchain di Ethereum in particolare stanno rivoluzionando il mondo delle transazioni online e i metodi di instaurazione e di svolgimento di rapporti contrattuali tra le parti. Il presente contributo intende illustrare come, a partire da questi due importanti pietre angolari della recente storia delle nuove tecnologie, si sia tornati a parlare di smart contract, soprattutto, nel mondo giuridico. Dalla genesi e inquadramento legale della prima criptovaluta denominata bitcoin, al germogliare delle distinte categorie di “token” rese possibili dagli standard tecnici offerti da Ethereum, passando per gli apporti dati dall’uso del linguaggio naturale e di ulteriori soluzioni software complementari, questo lavoro indagherà la validità legale degli smart contract e degli standard tecnici di Ethereum e, trattando dell’evoluzione in smart legal contracts, arriverà ad individuare talune strade per la standardizzazione degli stessi.
The advent of blockchain technology in general and the subsequent arrival of the Ethereum blockchain in particular are revolutionizing the world of online transactions, and the methods of establishing and carrying out contractual relationships between parties. This paper intends to illustrate how, starting from these two important cornerstones of the recent history of new technologies, we have started again to discuss smart contracts, especially in the legal sector. From the genesis and legal framework of the first cryptocurrency named bitcoin, to the germination of the distinct “token” categories made possible by the technical standards offered by Ethereum, going through the contributions given by the use of natural language and other complementary software solutions, this work will investigate the legal validity of smart contracts and the Ethereum technical standards and, dealing with the evolution into smart legal contracts, will identify certain routes for their standardization.
