La trasformazione digitale sta rapidamente modificando le relazioni sociali, i rapporti economici e l’assetto stesso dei mercati finanziari. Tale rivoluzione ha determinato la nascita di nuovi operatori finanziari che si affiancano a quelli già esistenti. La loro presenza sul mercato rende necessaria una regolamentazione capace di garantire la trasparenza ai clienti e di tutelare i loro interessi. Di fronte agli inarrestabili mutamenti derivanti dal fenomeno Fintech, le Autorità di Vigilanza rivestono un ruolo fondamentale, dovendo regolare situazioni inedite e, allo stesso tempo, garantire la sicurezza del sistema finanziario. Il contributo analizza il fenomeno del peer – to – peer lending, gli schemi operativi attuali mediante cui si concretizza la relativa attività, le parti del rapporto e i loro interessi e, infine, si tenterà di evidenziarne le potenzialità applicative e i benefici che possono derivare dall’utilizzo delle piattaforme ai fini della raccolta del risparmio.
The digital transformation is rapidly changing social and economic relations and the very structure of the financial markets. This revolution has led to the birth of new financial operators who join the existing ones. Their presence on the market requires regulation capable of guaranteeing transparency to customers and protecting their interests. In the face of unstoppable changes deriving from the Fintech phenomenon, the Supervisory Authorities play a fundamental role, having to regulate unprecedented situations and, at the same time, guarantee the security of the financial system. This paper analyzes the phenomenon of peer – to – peer lending, the current operational schemes through which the related activity is realized, the parts of the relationship and their interests and, finally, an attempt will be made to highlight the applicative potential and the benefits that can derive from the use of the platforms for the purpose of collecting savings.
