On 20 September 2010 the Court of Madrid rendered its decision in Telecinco v YouTube, an interesting case involving the provision of video-sharing services by the well-known platform YouTube (Gestevision Telecinco S.A.-Telecinco Cinema S.A.U. v YouTube). The Court affirmed that YouTube (i) is a hosting provider and (ii) is exempted from liability for the copyright infringement committed by its users.
