U.S. Senate Committee on Commerce, Science and Communication: The Invalidation of the EU-US Privacy Shield and the Future of Transatlantic Data Flows

On December 9th, U.S. Senator Roger Wicker – chairman of the Committee on Commerce, Science, and Transportation – will convene a hearing titled “The Invalidation of the EU-US Privacy Shield and the Future of Transatlantic Data Flows”.

The hearing will explore the policy issues that led to the CJEU invalidation of the EU-US Privacy Shield Framework (Schrems II) and will examine the impact of that decision on U.S. businesses engaging in transatlantic digital commerce. The question to be addressed is: what steps should the U.S. Government take to develop a successor data transfer framework?

The hearing well fits with the new transatlantic agenda for global change, proposed on December 2nd by the European Commission and the High Representative, by which EU means to start – among others – a new specific dialogue with the US on the responsibility of online platforms and on the development of a common approach on Artificial Intelligence, data flows, and other critical technologies.
