Synopsis
The talk will focus on the degree of copyright protection in the digital era, with specific regard to the European experience. Starting from the “new” constitutional status recognized to Intellectual Property by the Charter of Fundamental Rights of European Union, the lecture will explore if and how the Court of Justice of European Union has taken seriously the new provision (art. 16, par. 2 of the above mentioned Charter) in balancing copyright with other conflicting rights in Internet. The second part of the speech, after having touched upon the relevant case law of the European Court of Human Rights, will focus on the domestic mechanisms of copyright protection and enforcement in Internet, comparing, more precisely, the French and Italian experiences.
Professor Calboli will introduce the speaker and act as a moderator for the debate questions following the lecture.
Speaker’s Profile
Oreste Pollicino is full Professor of Constitutional Law, Bocconi University, Milan. He is the author of 5 monographs, 14 edited books and more than 100 articles and chapters in the field of antidiscrimination law, European constitutional law, Internet law and constitutional adjudication. He is working as legal expert in these fields for OSCE, Council of Europe and European Commission. The main findings of last (co-edited) Book Internet and Constitutional Law, Routledge, 2016 will be part of the lecture.
